Terms of Service

1. Accepting these terms

By accessing or using Cherrypicker, including by creating an account, you agree to these Terms of Service and acknowledge the Privacy Policy. If you do not agree, do not use the service. If you use Cherrypicker on behalf of someone else, you must have the required authority. These terms do not themselves authorize a college to disclose another person’s education records, waive statutory student privacy rights, or replace a separate pilot participation agreement. The Privacy Policy describes processing, public features, and current privacy-control limitations; please read it before submitting information.

2. Eligibility

You must be at least 13 years old to use Cherrypicker. If you are under the age of legal majority where you live, use the service only with permission from a parent or guardian. Permission to use the service does not by itself give a parent or guardian access to college education records. You may use Cherrypicker only where doing so is lawful.

3. Accounts and your responsibilities

Signed-in accounts use Google authentication through Supabase. You are responsible for maintaining control of your Google account and device sessions, providing accurate information, and promptly reporting suspected unauthorized access. Do not share an account, impersonate another person, or upload academic records you do not have permission to use.

4. An independent planning aid

Cherrypicker is an independent student project and academic planning aid, owned and operated by Enzo Emami. References to Foothill College, De Anza College, the Foothill–De Anza Community College District, ASSIST, UC, CSU, or other institutions do not imply their endorsement. The pilot described in section 13 is supported by the De Anza College Honors Society; that support is not an endorsement by De Anza College or the district. Any separately described pilot collaboration does not make Cherrypicker an official advising or enrollment service.

Cherrypicker is not an official counselor, registrar, admissions office, articulation authority, enrollment system, or degree-audit system. It cannot register you for classes, make decisions for a college, or replace advice from an authorized academic professional.

5. Academic information changes

Course plans, requirements, articulations, prerequisites, schedules, seat counts, modalities, instructors, deadlines, transfer eligibility, and admission rules may change or contain errors. Some source data is scraped, transformed, incomplete, pending review, or published for a particular catalog year. Public seat information is a periodically refreshed snapshot and can lag the college’s registration system. A displayed seat count is not a reservation.

Before making an important decision, verify it with official college catalogs, ASSIST, institution websites, and the appropriate counselor, registrar, articulation officer, or admissions office. You are responsible for checking current deadlines, filing requirements, residency rules, prerequisites, and official program requirements.

6. No academic outcome guarantee

Cherrypicker does not guarantee transfer, admission, graduation, degree or certificate completion, course availability, seat availability, enrollment, prerequisite clearance, articulation acceptance, financial-aid eligibility, or that a proposed schedule will be compatible or remain unchanged. A “complete,” “eligible,” “top pick,” or similar label is a planning calculation, not an official determination.

7. AI features

Ask—Cherrypicker’s one AI assistant—and the small AI helpers that interpret your written planning and scheduling preferences provide informational assistance only. Their output is generated from catalog, articulation, and planning data that may be incomplete or out of date, and it can be wrong. It is not counseling, an official determination, or an approval of anything. Your plan and your schedules are produced by Cherrypicker’s deterministic planner and solver, not by an AI model.

Personalized Ask can use your goals, plan, and completed course codes as described in the Privacy Policy. Its setting is in Account Settings. Transcript uploads use AI recovery for unclear lines unless you uncheck the AI option shown before upload, which is checked by default. Uncheck it, or enter courses manually, if you do not want transcript lines processed by AI. Other AI preference features process the text or conversations you submit. These controls have different scopes, as explained in the Privacy Policy. Whether personalization is on or off, you remain responsible for confirming requirements, prerequisites, articulations, and deadlines with the sources named in section 5 before you rely on an answer.

8. Friend Mode

Friend Mode shares planning information only with the groups you choose to join and only to the extent you choose to share. You are responsible for deciding who to share your planning and schedule information with, and you should share only information you are comfortable making visible to the people in that group. Other members may retain copies. You must not use shared information to harass, reidentify people in deidentified reports, or disclose another person’s private information without authority. Cherrypicker does not control what other members do with information you share with them.

9. Your content and academic information

You retain your rights in content you submit. You give Cherrypicker a limited, nonexclusive permission to store, process, and display it, and have the disclosed service providers process it, as needed to provide the features you use, maintain security, and honor your choices under the Privacy Policy. Academic uploads and manual entries are optional. This permission is not a transfer of ownership of your academic records, a blanket permission to publish them, or a waiver of privacy rights. This permission lasts only as needed for those purposes and the retention described in the Privacy Policy, including applicable legal obligations. Product evaluation or research must respect the stated purposes, privacy choices, deidentification requirements, and any applicable separate agreement.

Transcript PDFs are processed as described in the Privacy Policy and are not intended to be retained after parsing. You must review parsed academic information for accuracy before relying on or saving it. Instructor reviews and non-hidden bug reports use public or community-readable features. Reviews are stored with your account and are not anonymous; do not include private academic records, student IDs, passwords, or sensitive personal information in them.

10. Acceptable use

You agree not to:

• break the law, infringe rights, harass others, or submit unlawful, deceptive, defamatory, or abusive content;
• probe, bypass, disable, or interfere with authentication, access controls, rate limits, or service security;
• introduce malware, automate abusive traffic, overload the service, or scrape Cherrypicker in a way that disrupts it;
• misrepresent community content as an official institutional statement;
• submit false reports or reviews, manipulate ratings, or expose another person’s private information; or
• use the service to access school systems or records without authorization.

11. Cherrypicker materials

The Cherrypicker name, logo, interface, original text, software, and other original project materials are owned by the project owner or its licensors and are protected by applicable law. These terms give you a limited, personal, revocable right to use the service for its intended purpose. Academic catalog, articulation, institution, and other third-party content remains subject to the rights and terms of its source.

If you voluntarily send product suggestions or bug reports, you permit Cherrypicker to use that feedback to evaluate and improve the service. This does not transfer your academic records or grant a right to publish private information. Any assignment or licensing of original code, designs, or other project contributions will be addressed separately; ordinary app use is not such an assignment.

12. Third-party services and links

Cherrypicker depends on or links to services including Google, Supabase, Vercel, Anthropic, Stripe, ASSIST, college and university websites, and RateMyProfessors. Independent third-party sites have their own content and terms. Providers processing information for Cherrypicker are described in the Privacy Policy; using them does not remove Cherrypicker’s own legal or contractual data-protection duties. This section does not override an applicable institutional data agreement.

13. Service changes and availability

Individual planning and scheduling are free. Cherry includes 20 user messages per UTC calendar month; internal tool calls are not separate messages. Optional support contributions are one-time USD payments through Stripe, with no subscription or automatic renewal. A verified one-time contribution of more than $3 unlocks Cherrypicker Labs, starting with Plan with friends. Each participant needs their own Labs access. Eligibility requires a qualifying contribution with more than $3 remaining after refunds. Contributing does not change individual planning and scheduling access or the Cherry allowance. Historical student subscriptions are retired and future renewals have been stopped. Previous payments and invoices remain in billing history. No automatic refunds have been issued; contact admin@cherrypickerapp.net with billing or refund questions. Supporter recognition is optional and can be withdrawn. Labs features are experimental and may change or be removed.

Cherrypicker may add, remove, correct, or change features and data; impose reasonable limits; or suspend parts of the service. The service may be interrupted by maintenance, provider outages, source-data changes, or technical problems. Cherrypicker does not promise that every feature or academic data source will always be available.

The planned three-month PTK pilot is supported by the De Anza College Honors Society and is a voluntary evaluation of the existing service. Pilot dates, participation arrangements, and any specific contribution or study terms will be communicated separately. You may decline an optional survey, transcript upload, or academic entry; features needing that information may be incomplete. Joining a pilot does not itself start a paid subscription, grant access to Cherrypicker’s private source code or infrastructure, or authorize access to other students’ private records. The pilot’s end does not automatically delete your account or cancel any separately purchased subscription; the Privacy Policy explains deletion and billing.

14. Suspension and termination

Cherrypicker may restrict or terminate access when reasonably necessary to address abuse, security risks, unlawful conduct, repeated violations, or harm to the service or others. You may stop using Cherrypicker at any time. Signed-in users can delete their account through the account menu or Account Settings, subject to the deletion details in the Privacy Policy.

15. Disclaimer of warranties

To the extent permitted by law, Cherrypicker is provided “as is” and “as available,” without warranties of any kind, express or implied. This includes implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability. Nothing in these terms excludes a warranty that cannot legally be excluded or removes a nonwaivable privacy or data-protection obligation.

16. Limitation of liability

To the extent permitted by law, Cherrypicker and its project owner will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, opportunities, enrollment, admission, academic credit, or profits arising from use of the service. Cherrypicker’s total liability for claims relating to the service will not exceed the greater of $100 or the amount you paid Cherrypicker in the 12 months before the claim. Core planning setup — accounts, goals, coursework, and transfer progress — is free; Optional support contributions are processed through Stripe. Some jurisdictions do not allow certain limitations, so these limits apply only as far as the law permits.

17. Responsibility for misuse

If your unlawful use, content, or intentional violation of these terms causes a third-party claim against Cherrypicker, you agree to be responsible for the resulting reasonable losses and costs to the extent permitted by law. This does not apply to claims caused by Cherrypicker’s own conduct.

18. California law

California law governs these terms, without regard to conflict-of-law rules. Any dispute that is not eligible for small-claims court will be brought in a state or federal court with jurisdiction in California, unless applicable consumer law requires otherwise.

19. Changes to these terms

This October 11, 2026 revision states that the pilot is supported by the De Anza College Honors Society. The October 1, 2026 revision explained the one-time year pass, quarterly automatic renewal, and cancellation. Cherrypicker may update these terms as the service changes. Updated terms will be posted here with a revised “Last updated” date. Material changes will be identified and communicated through an appropriate channel. Website updates do not override a separately signed pilot or institutional agreement, waive nonwaivable rights, or authorize retroactive expansion of restricted data uses. Additional acceptance or permission will be obtained where required.

20. General

If part of these terms is unenforceable, the remaining terms continue to apply. A failure to enforce a term is not a waiver. These terms and the Privacy Policy govern ordinary use. Separately accepted pilot participation terms or an authorized institutional data agreement may also apply to their stated scope. More protective applicable data-use restrictions are not reduced by these general terms. Student records are not assigned to Cherrypicker as software or intellectual-property contributions.
